Safety Belt Laws in Massachusetts
· Effective February 1, 1994 all drivers and passengers of motor vehicles, including trucks and vans, must wear a safety belt, which is properly fastened and adjusted when traveling on all Massachusetts roadways.
· Any person who operates a motor vehicle without a safety belt, or any person 16 and over who rides as a passenger in a motor vehicle without wearing a safety belt is subject to a $25.00 fine.
· Any operator of a motor vehicle is subject to an additional fine of $25.00 for each person under the age of 16 who is not wearing a safety belt.
· This law is a secondary offense, and will be enforced by law enforcement agencies only when an operator of a motor vehicle has stopped for a violation of the motor vehicle laws or some other offense.
· The Child Passenger Safety Law has not changed. All children age 12 and under must be properly restrained in a car seat or safety belt when riding in a motor vehicle. This law is a primary offense, and an operator may be stopped for not having children 12 and under restrained.
